February 15th 2013: The American reality star Kim Kardashian is one up over her erstwhile lover, and the NBA star Kris Humphries as the divorce goes to trial. It’s a courtroom drama that a lot of people are interested in.
Kris Humphries had accused that Kim had committed a fraud by never intending to be actually married. This is what sparked off the debate and the legal tussle. It is now all set to go into trial, as announced by a Los Angeles judge. According to the superior court judge in Los Angeles, Humphries has had adequate time to prepare himself for this particular trial. A trial date has been set – the tentative date is the 6th of May 2013. Neither Humphries nor Kim Kardashian was present in the court room at the time this announcement was made.
The attorney of Kris Humphries, Marshall Waller has filed papers this Thursday asking to be removed from this particular case. He has been claiming for some time now that it was becoming very difficult for him to gather evidence from different entertainment companies with whom Kim is associated.
Kim Kardashian who is now pregnant with Kanye West’s child, due in July this year, has repeatedly denied the claims made by her former love, Kris Humphries regarding her fidelity towards him. According to her, ever since her split with the NBA star, she has been literally handcuffed to him in the legal sense of the term.
Laura Wasser, Kim’s lawyer, feels that holding a trial is the only way this case can be brought to a close. There is no other way to end the furor she says. Laura says that no fraud has been committed by her client, and therefore, there is no case really.
Legal experts are highly doubtful of Humphries capacity to win an annulment on the grounds of fraud. They say that argument that Kim made him believe that she was interested, while she was actually not, won’t be enough. At best, this is a long shot.
By going into trial, Kim Kardashian is closer to her goal of getting the divorce from Kris Humphries before she gives birth to her and Kanye West’s child.
Humphries and Kardashian have both been summoned by the court to appear in person for a hearing scheduled to take place on the 12th of April. This hearing is the last effort to resolve the matter amicably.
According to Humphries’ attorney Waller, each and every case can be settled before it goes to trial. The statement was given by him to the People Magazine at a hearing which took place on an earlier date.
